Let's see what's wrong with this...
1.) It was not a Powerball-like "gamble", but a no-brainer that Gordon would win by at least 5-4.
2.) A lottery is a voluntary purchase whereas the status quo prefers using force to achieve its diversity goals and to keep most students/parents captive to a government monopoly. It's those who prefer political "powerball" who want to jam their preferred version of utopia down the throats of others. Someone's gotta win, and I'm sure glad it wasn't them.
3.) A lottery benefits the State, those who play ex ante (why would they play otherwise?), and especially, those who win ex post. The Court's decision benefits Teddy Gordon modestly (netting out the resources he expended) and everyone will be a winner from the end of this unjust and inefficient method.
The only sure bet in this: the status quo will continue to try to avoid the ramifications of the Court's decision. The initial lawsuit, by African-American parents/students not being allowed into a school because they were black, should have been enough to settle this-- but wasn't. The saddest part of all of this is that government schools will continue to provide an overly-expensive and sadly-ineffective education to millions of students-- to preserve the status quo and to send lottery-like winnings to a special interest group.
